Overview

On March 14, 2005, a lawsuit was filed in the United States District Court for the Southern District of Ohio naming only GoAntiques, Inc. ("GoAntiques") as a defendant. On June 24, 2005, the lawsuit was amended to add eBay, Inc. ("eBay") as a defendant and alleging that eBay and GoAntiques facilitated "shill bidding" to artificially inflate prices at the auctions conducted on the eBay Live Auctions venue. The class action complaint asserted various claims against both eBay and GoAntiques alleging (among other things) violations of the online user agreements and laws prohibiting deceptive trade practices.

eBay and GoAntiques deny all of these allegations, asserting that prospective buyers were informed of the nature of the bidding process before being permitted to participate in a live auction and that GoAntiques' auctioneer was protecting the sellers' confidential reserves in a lawful manner.

The Notice of Pendency of Class Action and Proposed Settlement provides a summary of the terms of the proposed Settlement. It also explains the lawsuit, Class Members' legal rights under the Settlement, what benefits are available to Class Members under the Settlement, and how to obtain the benefits of the Settlement.

Making Claims to Receive Payment

To make a valid claim for payment, you must: (1) fill out and submit the Claim Form electronically; (2) print the Certification page of your Claim Form; and sign it, and return it by mail, along with any supporting documentation to the following address:

Your claim must be filed electronically on or before October 30, 2006 and your signed Certification must be postmarked on or before October 30, 2006.

Settlement Hearing

The Court will hold a hearing on September 28, 2006 at 10:00 a.m., before the Magistrate Judge Norah McCann King, United States District Judge for the Southern District of Ohio, Courtroom 228, 85 Marconi Boulevard, Columbus, Ohio 43215. As a Class Member, you are not required to attend the hearing in order to participate in the Settlement, nor do you have to attend the hearing for the Court to consider your objection or other written comments.
